Terms of Service

These Terms of Service ("Terms") govern your access to and use of Endstack's cloud desktop platform, including the endOS web interface, desktop containers, built-in AI agent, and related services (collectively, the "Service"), operated by Endstack ("we," "us," or "our"). Our website is located at endstack.com.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Endstack provides a persistent, cloud-based desktop operating system ("endOS") powered by Linux containers running on cloud infrastructure. Each user or team receives a dedicated desktop environment accessible via a web browser at a unique subdomain (e.g., your-slug.endstack.com). The Service includes:
- A full desktop environment with file management, a web browser, terminal, code editor, and other built-in applications
- A built-in AI assistant ("Endstack Agent") that can interact with your desktop, files, browser, and terminal
- Remote desktop streaming via WebRTC
- Team and shared desktop capabilities
- Access from any device with a modern web browser
2. Eligibility
You must be at least 16 years old to use the Service. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements.
3. Account Registration
3.1 Authentication
The Service uses Google OAuth for authentication. When you sign in, we receive your name, email address, and profile picture from your Google account. You do not create a separate password with Endstack.
3.2 Invite Codes
During our early-access period, certain cloud desktop management features may require redeeming a valid invite code after sign-in. This requirement may change as the Service becomes generally available.
3.3 Account Security
You are responsible for all activity under your account. You must not share your account credentials or allow others to access your account. Notify us immediately at support@endstack.com if you suspect unauthorized access.
4. Service Plans
4.1 Plan Types
We offer Individual plans and Team plans. Enterprise plans may be offered in the future. Plan details, pricing, features, and usage limits are described on our website and may change over time.
4.2 Free Tier
We may offer a free tier with limited capabilities. Free-tier availability, features, and limitations are subject to change at our discretion.
4.3 Payment
Payment terms, billing cycles, and refund policies will be communicated at the time of plan selection and purchase. All fees are non-refundable unless otherwise stated or required by law.
5. Your Data and Your Desktop
5.1 Data Architecture
Your desktop environment runs inside a dedicated container with persistent storage. Your files, documents, application data, AI agent conversations, memory, terminal history, and desktop settings are stored locally within your container. We do not store this user-generated content on external databases outside your container.
5.2 Account Metadata
We store a limited set of account and infrastructure metadata outside your container, including: your authentication identity (name, email, profile picture from Google), your desktop instance mapping (which container belongs to which user), team membership and roles, and plan information. This metadata is stored in our database infrastructure (Supabase/PostgreSQL).
5.3 Ownership of Your Content
You retain ownership of all content you create, upload, or store within your desktop environment. We do not claim any intellectual property rights over your content. We do not access, review, or use your content except as necessary to provide the Service (e.g., the AI agent processing files you explicitly ask it to work with).
5.4 Data Portability
Since your data resides within a standard Linux filesystem, it is inherently portable. You may download, copy, or transfer your files at any time using the tools available within your desktop environment.
6. AI Agent and Third-Party AI Services
6.1 Built-In AI Agent
The Endstack Agent operates within your desktop environment and can access your files, run terminal commands, browse the web, and perform other actions on your behalf. The agent only acts when you instruct it to do so or when you configure scheduled tasks.
6.2 AI Model Providers
When you use the AI agent, your conversation messages and relevant context are sent to third-party AI model providers for inference. We currently use:
- OpenAI — for chat, reasoning, code assistance, vision (image understanding), and image generation
- Exa — for web search capabilities
- Morph — for code editing assistance
We configure our AI provider integrations to opt out of server-side training data storage where the provider supports it (e.g., OpenAI store: false). However, third-party AI providers are governed by their own terms of service and privacy policies, which you should review:
6.3 What Is Sent to AI Providers
When you interact with the AI agent, the following may be sent to AI model providers:
- Your conversation messages and the agent's system instructions
- File contents that you ask the agent to read or work with
- Images that you ask the agent to analyze
- Desktop context (e.g., open applications, current working directory)
- Summaries of recent conversations
We do not send your entire filesystem or any data you have not directed the agent to interact with.
6.4 AI Limitations
AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and verifying any output produced by the AI agent. We do not guarantee the accuracy, reliability, or suitability of AI-generated content for any particular purpose.
7. Team and Shared Desktops
7.1 Team Plans
Team plans allow multiple users to access a shared desktop environment. The team administrator manages membership, roles, and permissions.
7.2 Shared Responsibility
In shared desktop environments, all team members may have access to shared files and resources. The team administrator is responsible for managing access controls and ensuring appropriate use by team members.
7.3 User Isolation
Each user on a team plan has their own Linux user account within the shared container, providing a degree of user-level isolation. However, shared desktops inherently involve shared resources, and users should exercise judgment about what data they store in shared environments.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Distribute malware, viruses, or other harmful code outside your container
- Attempt to gain unauthorized access to other users' containers, our infrastructure, or third-party systems
- Use the Service for cryptocurrency mining without authorization
- Send spam, phishing, or other unsolicited communications
- Engage in any activity that could damage, disable, or impair the Service or interfere with other users' access
- Use the AI agent to generate content that violates applicable law or the usage policies of our AI providers
- Resell, sublicense, or redistribute the Service without our written consent
- Circumvent usage limits, rate limits, or access controls
- Use the Service to conduct denial-of-service attacks or similar disruptive activities
- Host illegal content within your desktop environment
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation.
9. Intellectual Property
9.1 Our IP
The Service, including the endOS interface, built-in applications, Endstack Agent, infrastructure, documentation, and branding, is owned by Endstack and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
9.2 Open Source
Certain components of the Service may incorporate open-source software. Such software is governed by its respective open-source licenses.
9.3 Feedback
If you provide suggestions, feature requests, or other feedback about the Service, we may use it without any obligation to you.
10. Service Availability and Modifications
10.1 Uptime
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
10.2 Modifications
We may modify, update, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
11. Termination
11.1 By You
You may stop using the Service and request account deletion at any time by contacting support@endstack.com.
11.2 By Us
We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Where practical, we will provide advance notice and an opportunity to export your data before termination.
11.3 Effect of Termination
Upon termination, your right to access the Service ceases. We may delete your container and its contents after a reasonable retention period following termination. Account metadata may be retained as required for legal, regulatory, or legitimate business purposes.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE SERVICE IS AT YOUR OWN RISK.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold Endstack harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
15.2 Informal Resolution
Before filing any formal dispute, you agree to contact us at support@endstack.com and attempt to resolve the issue informally for at least thirty (30) days.
15.3 Arbitration
Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
15.4 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the email associated with your account or through the Service at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
17. Miscellaneous
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Endstack regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- No Waiver. Our failure to enforce any provision does not waive our right to enforce it in the future.
- Assignment. You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
